Out-of-contract rates can apply when a previous business-energy contract has ended and a replacement agreement has not been put in place.
They are usually designed as temporary/default arrangements rather than a negotiated long-term commercial position.
If you discover that a site is out of contract, first confirm the current tariff and contractual status. Then establish the consumption profile, review available options and decide whether a new arrangement is appropriate.
The best defence is simple renewal management: record every contract end date and review it well before expiry.
